Hi, We are in the process in getting the permission to use the Scarborough Hall. All the youth in Scarborough are extremely keen. We had a meeting with the City of Cape Town on Wednesday, there were a few of the youth present but there are many more of you there. The major meeting will be this Wednesday 23 at 6o'clock during the Ratepayers meeting. So come on guys please come and speak up. We won't get this right if you don't step up and take action. Also please leave you comment as to if you support the idea, or for some reason do not support the idea. Please leave any questions as well and will be answered by the Scarborough Youth Committee. Thank you to all who came to the last meeting Especially the youth. We are hoping to see double even triple the amount of people next time. Hope to see you all there on Wednesday the 23rd at 6o'clock at the Scarborough Hall. Write it on your hand, make a remind on your cell phone or put it on your fridge. Just make sure you there. If some do not know what is happening. The Scarborough Youth want to use the hall as a place t come together. We would like t put a table tenis table, a pool able, fose ball, couches, TV and a DVD player. The Scarborough youth need a place where they can come together and have some fun. And do they have the names and contact details for the municipal officials and Red Hill representatives who came to the 17 May meeting? Also, does anyone know whether or not anyone is writing minutes of the 17 May meeting? Who did the attendance record go to? Graham Noble |

Firstly, on behalf of the Scarborough youth, we wish to thank all those Scarborough residents for so readily responding to our funding appeal for equipment. We have had a fantastic response and gives one a really good feeling about what we, as Scarborough, are trying to achieve. To date: The following pieces of equipment have either been fully funded or donated: 1 Pool Table 1 Table Tennis Table, Bats and Net 1 Football Machine (Foosball) 1 Multi Media player A big 'Thank you' to Victor De La Cour, Lennox Grobler, Brendan Kannemeyer, Janis Corr, Geoff Higgo, Kevin O'Brein, Patricia , Barbara Bridge, Craig Price and Antonnie Van Gelder. Your donations towards equipment will be acknowledged with a small plaque on the piece of equipment that you have assisted in procuring. Furthermore, we have also received firm offers of training from residents in Beach Soccer , HIV and Aids Awareness , Arts and Crafts, Drama Music ,Computer Training. So as you can see, there is fantastic support and it is bringing the community together, mobilising around our youth, our future. There is, however, one stumbling block still to overcome, which we believe, will be resolved very shortly. This is the use of the Scarborough Community Centre. An initial meeting held at the Scarborough Community Centre on Wednesday 16 May 2007, attended by over 30 residents, including representatives of the Scarborough youth and two representatives of the Red Hill Community, were given a presentation by the Youth Coordinator: Social Development of the City of Cape Town, Chantell Adams. Chantell outlined how a local youth forum would need to be set up. She keenly expressed that the City of Cape Town would be fully supportive of the free use of the Scarborough Community Centre and the Social Development Department would be actively involved in setting up this Youth Forum, together with a representative youth committee, supported by a strong parents steering committee. Understandably, the youth representatives of Scarborough are 'champing at the bit' to get started and get the equipment into the centre. However, the meeting agreed that further consultations with the Scarborough Residents and Ratepayers Association would take place on Wednesday 23 May at 6.00 pm, where any outstanding issues would be dealt with and where the Youth will be handing over a founding document, outlining their Mission, Aims and Objectives. Finally, please circulate this e mail to all supporters of the Scarborough Youth Group, especially all Scarborough kids, of all ages, and we look forward to seeing you all at the Scarborough Community Centre on Wednesday 23 May at 6.00 pm. Hi,
I am a a bit confused, not sure who posted the info re the meeting on Wednesday, but it says meeting starts at 6.00pm, then it says get there by 8.00pm. It also fails to mention that this meeting is also with the parents steering committee and the youth themselves, it is not just a meeting between the Scarborough Ratepayers and City of Cape Town. Hi,
It would be helpful if the Scarborough Residents and Ratepayers association, could perhaps table their concerns and any questions pertaining to the youth group using the community centre, before the meeting on wednesday, so the parents steering committee and youth can address these issues. I presume the chairman of the ratepayers association will be chairing the meeting? Janis |

Victor De La Cour briefly states the situation of the Community Centre as it actually stands not as opinioned to at least provide a moment of clarity if possible.
Being an Architect and working for a massive property group I have had the fortune to see how the correct legal side of property is conducted and have learnt that emotions (although necessary) are not counted in the war of property decisions. To address all the opinions is to embrace an open democratic system – but then to evaluate a decision, democracy fails us and the rule of law moves in as the only benchmark of an official decision. In our case the P.O.S. laws will be the only ones to apply
I believe that the meeting was a veritable bun fight! Incredulous that there would be any opposition to a youth programme and using the community centre! Basically the community centre is a P.O.S. (public open space) and belongs to the City of Cape Town, not to the ratepayers or to the community. All citizens of Cape Town are not to be denied access to a P.O.S. unless by Parliamentary decree (never occurred) this essentially means that the entire youth of Hanover Park could demand the use of the centre and no community or ratepayers have any legal right to prevent them. Of course this is extreme but unfortunately rights are rights despite peoples own agenda. All community proposals are a standard mix of supporters and detractors, the important point is that they both have an equal say and the final decision is by democratic proxy………….majority rules. Personal grievances and surreptitious agendas can be heard but ultimately no one opinion is allowed to dominate. As the registered owner of the property the use of the community centre is the right of the City to adjudicate……….. no one else can make that call. If you live right next door to a P.O,S. you have to accept the noise, traffic and general use of the centre – if you don't like that then there is no recourse for you except to sell and move, free market dictates that you made the choice to live next to a zoned P.O.S. and you must accept the rule of law that comes with it. As for trying to control the use of the centre as a neighbour to a P.O.S. will land you in big trouble with the Local Authority. So, to sum up, the community centre is public territory and can be used as such within its legal confines as defined by the Council, without approval from any community or ratepayers. If we are working within the P.O.S. guidelines we can operate a youth centre without any surveys, reports or approvals from anyone barring the Council The overall concept of a youth centre is both logical and necessary and will be supported by the Local Authority and even Central Government. Hi Victor, I appreciate your clarity on POS. It sets a precedent, provides a legal framework to operate within and therefore pre-empts problems that could arise. We want this process to be as smoothe and peaceful as possible.
It is a great victory to get the Scarborough Community Centre for our youth. We have been trying to get the Community Centre "flowing" with youth activities since Edward Thresher's time. All attempts were effectively blocked or unsupported by the ruling Ratepayers Committees. Effectively this strangulation of progress created a white elephant of our community centre. A years attempt to get a local skate park zoned in Scarborough with all the various organizations and "authorities" was met by opposition and "passing the buck" till it fell off the radar screen.
Now is the time! With a network of supportive parents we will actualise the vision.

The legal process going forward is to:
1. make an application to the Council for a set use of the community centre, the Council will require a statement and methodology for such application. 2. the council will notify residents and invite comments, usually over a 21 day period, the comments will be considered against the application (this is where the noises are allowed….the noises are looked at carefully and if they have a personal emotional slant or selfish neighbour motivations or are just opposed due to no real reason at all, they are dismissed, and are not allowed to appeal….maybe to a minister but even then Iit will be overruled because the Council has endorsed it.) 3. thereafter approval will be granted to a represented group and allocated times and access will be set. Game over. 4. we cannot deny any citizen of capetown coming to the youth programme so outsiders are a non issue. 5. we follow the process, we don't need any meetings or approvals with residents, rate payers or individuals, we don't have to satisfy any requests or demands except from the Council. However it is always better to apply with the support letters of the above to ease the application. 6. we need to form a committee to have a representative body to apply to the Council officially.
On a lighter note I'm glad to see that there is a parents drive to support the kids in our village and a Friday evening will be just great for them!

Everyone don't forget the meeting tomorrow!! Everyone is welcome, please we need as many people as possible. The hall at 6o'clock tomorrow. Tomorrow night i will post as how it went and what the result turned out to be, hopefully in a good result that we can use the Hall.

CONSTITUTION OF THE SCARBOROUGH YOUTH GROUP
1. NAME
1.1 The organisation hereby constituted will be called ‘The Scarborough Youth Group’; 1.2 Its shortened name will be ‘The Scarborough Youth’
1.3 Body Corporate
The organisation will:
• Exist in its own right, separated from its members; • Continue to exist even when its membership changes and there are different office bearers; • Be able to own property and other possessions • Be able to sue and be sued in its own name.
2. OBJECTIVES
The organisations main objectives are:
• To set up, run and manage a membership- based youth group in the Scarborough Community Centre; • To encourage the Youth of Scarborough to come together in a safe place; • To acquire, equip or purchase equipment for the use of the Scarborough Youth; • To arrange entertainment evenings and sport gatherings at the Scarborough Community Centre; • To arrange Special Events for the youth in Scarborough; • To organise training workshops on a range of issues that interest and affect the youth.
The organisations secondary objectives are:
• To subscribe to the South African Youth Charter; • To work closely with the City of Cape Town: Social Development Youth Coordinators; • To build a relationship with the youth from the neighbouring community of Red Hill; • To liaise with all relevant Community based organisations in the local area; • To liaise and coordinate our activities with all present and future users of the Scarborough Community Centre;
3. INCOME AND PROPERTY
3.1 The organisation takes responsibility for everything that it owns.
3.2 The organisation may not distribute its money or property to its members or office bearers. The only time it can do this is if it pays for work that a member or office bearer of the organisation has done for the organisation. The payment must be a reasonable amount for the work that has been done.
3.3 A member of the organisation can only get money back from the organisation for expenses that she or he has paid for on behalf of the organisation.
3.4 Members or office bearers of the organisation do not have rights over things that belong to the organisation.
4. MEMBERSHIP AND GENERAL MEETINGS
4.1 If a person wants to become a member of the organisation, she or he will have to ask the organisations management committee. The management committee has the right to say no.
4.2 Members of the organisation must attend its annual general meetings.At the Annual general meeting, members exercise their rights to determine the policy of the organisation. 4. MANAGEMENT
5.1A management committee will manage the organisation. The management Committee will be made up of not less than 6 members. They are the office Bearers of the organisation.
5.2 Office bearers will serve for one year, but they can stand for re-election for another term in office after that. Depending on what kind of services they give to the organisation, they can stand for re-election into office again and again. This is so long as their services are needed and they are ready to give their services.
5.3 If a member of the management committee does not attend three management meetings in a row, without having applied for and obtained leave of absence from the management committee, then the management committee will find a new member to take that person’s place.
5.4 The management committee will meet at least once a month. More than half of the members need to be at the meeting to make decisions that are allowed to be
carried forward. This constitutes a quorum.
5.5 Minutes will be taken at every meeting to record the management committee’s decisions. The minutes of each meeting will be given to the management committee members at least two weeks before the next meeting. The minutes shall be confirmed as a true record of proceedings, by the next meeting of the management committee and shall thereafter be signed by the chairperson.
5.6 The organisation has the right to form sub committees. The decisions that sub Committees take must be given to the management committee. The management Committee must decide whether to agree to them or not at its next meeting. The Meetings should take place soon after the sub committee’s meeting. By agreeing to decisions taken by the sub committees, the management committee ratifies them.
5.7 All members of the organisation have to abide by the decisions that are taken by the management committee.
5. POWERS OF THE ORGANISATION
The management committee may take on the power and authority that it believes it needs to be able to achieve its objectives that are stated in point number 2 of this constitution. Its activities must abide by the law.
6.1 The management committee has the power and authority to raise funds or invite and receive contributions.
6.2 The management committee does, however, have the power to buy, hire or exchange for any property that it needs to achieve its objectives.
6.3 The management committee has the right to make by-laws for proper Management, including procedure for application, approval and termination of Membership.
6.4 The organisation will decide on the powers and functions of the office bearers.
6. MEETINGS AND PROCEDURES OF THE COMMITTEE
7.1The management committee must hold at least two ordinary meetings per year.
7.2 The chairperson, or two members of the committee, can call a special meeting if they want to. But they must let the other management committee members know the date of the proposed meeting not less than 21 days before it is due to take place. They must also tell the other members of the committee which issues will be discussed at the meeting. If, however, one of the matters to be discussed is to appoint as new management committee member, than those calling the meeting must give the other committee members not less than 30 days notice.
7.3 The chairperson shall act as the chairperson of the management committee. If the chairperson does not attend a meeting, then members of the committee who are present choose which one of them will chair the meeting. This must be done before the meeting starts.
7.4 There shall be a quorum whenever such a meeting is held.
7.5 When necessary, the management committee will vote on issues. If the votes are equal on an issue, then the chairperson has either a second or deciding vote.
7.6 Minutes of all meetings must be kept safely and always be on hand for members to consult.
7.7 If the management committee thinks it is necessary, then it can decide to set up one or more sub- committees. It may decide to do this to get some work done quickly. It may want a sub committee to do an enquiry. There must be at least three people on a sub- committee. The sub- committee must report back regularly to the management committee on its activities.
8. ANNUAL GENERAL MEETING (AGM)
The annual general meeting must be held once every year, towards the end of the organisations financial year.
The organisation should deal with the following business, amongst others, at its annual general meeting:
• Agree to the items to be discussed on the agenda; • Write down who is there and who sent apologies because they cannot attend; • Read and confirm the previous meeting’s minutes with matters arising. • Chairperson’s report; • Treasurer’s report; • Changes to the constitution that members may want to make; • Elect new office bearers; • General; • Close the meeting.
9. FINANCE
9.1 An accounting officer shall be appointed at the annual general meeting. His or her duty is to keep a check on the finances of the organisation.
9.2 The treasurer’s job is to control the day to day finances of the organisation. The treasurer shall arrange for all the funds to be put into a bank account in the name of the organisation. The treasurer must also keep proper records of all finances.
9.3 Whenever funds are taken out of the bank account, the chairperson and at least two other members of the organisation must sign the withdrawal or cheque.
9.4 The financial year of the organisation ends on the 31 March each year.
9.5 The organisations accounting records and reports must be ready and sent to the Director of Non Profit Organisations, within six months after the financial year end.
9.6 If the organisation has funds that can be invested, the funds may be invested with registered financial institutions.
10. CHANGES TO THE CONSTITUTION
10.1 The constitution can be changed by a resolution. The resolution has to be agreed upon and passed by not less than two thirds of the members who are the Annual general meeting or special general meeting. Members must vote at this meeting to change the constitution.
10.2 Two thirds of the members shall be present at a meeting (‘the quorum’) before a decision to change the constitution is taken. Any annual general meeting may vote upon such a motion, if the details of the changes are set out in the notice referred to in 7.3.
10.3 A written notice must go out not less than fourteen (14) days before the meeting at which changes to the constitution are going to be proposed. The notice must indicate the proposed changes to the constitution that will be discussed at the meeting.
10.4 No amendments may be made which would have the effect of making the organisation cease to exist.
11. DISSOLUTION/WINDING UP
11.1 The organisation may closed down if at least two thirds of the members present and voting at a meeting convened for the purpose of considering such matter, are in favour of closing down.
11.2 When the organisation closes down it has to pay off all its debts. After doing this, if there is property or money left over it should not be paid or given to members of the organisation. It should be given in some way to another non profit organisation that has similar objectives. The organisations general meeting can decide what organisation this should be.

I'm glad to see a youth element involved in driving a facility that will benefit them. The constitution while sound does not burst with youtfulness. I'd like to see a more readable and inspiring version (non-official, but meaningful) coming from the unjaded. Obviously from wessa's side we would like to see more of an environmental ethos coming through (energy use in the centre, litter and waste reduction, youth programme content etc)
Because push comes to shove every now and then it is good to have the sue and be sued aspect of the const, really sewn up, though I see there is mention of this. Good luck with the process and outcome. |

Hi Patrick,
Thanks for those comments. The constitution is a model that we downloaded from the Deaprtment of Welfare, in order to registar as an NPO, only only change was that we added in the aims and objectives. The part re being sued is right up at the top. The first step we working towards is to get permission to use hall. We are planning a youth day celebration on june 16th, so will keep you posted re the programme. janis |

The City presented a generic Youth Constitution. It was decided at the meeting that both constitutions would be consulted; Terry Corr suggested "a marriage between the two." |

Opening and Welcome The meeting was devoted to discussion of use of the Scarborough Community Centre and the establishment of a Scarborough Youth Group. 2. Presentation by City of Cape Town Social Development Given was here in response to a call from this community for help in establishing a youth programme and in gaining access too the Scarborough Community Centre. The Social Development Directorate would certainly help where it could. He briefly described its six programmes, one of which was Early Childhood Development (ECD), which was relevant to the application by the Sunflower Community Preschool for use of the Centre. Another was Neighbourhood Development, helping communities establish civic bodies to provide a platform for other activities. Another Youth Development, within which a variety of projects could be undertaken aimed at offering young people a better life. The first step was to create a structure, or several structures for different activities. He handed out a generic constitution which could be adapted to suit the needs of each structure. Needs differ greatly from community to community. Activities undertaken in different communities therefore differed greatly, from arts & culture to sports and to HIV-AIDS. A typical approach was to use task teams to plan and get different activities going, and to have an overall body to keep things simple, to bring activities together and give more weight to any proposals made. The next step was to raise money to pay for the activities decided upon. Given stressed the importance of getting community buy-in. Competition can be good in business but not in social development. 3. Questions How can the City help? Social Development could help make facilities available but its funds are limited. The City wishes its facilities to be available to communities and be well utilized. This Centre is managed by the Sport & Recreation Directorate and a fee charged for its use, unlike facilities in Masiphumelele, for example, which were available free. How could Scarborough contribute towards transformation through its Youth Group? Red Hill is close and there is both potential and interest in working together. To make this possible, both need to want this and to see joint action to be in their own best interests. Would a proposal from Scarborough to Social Development stand a better chance of success if it included areas like Red Hill and Ocean View? Not necessarily. Social Development would assess the merit of the proposal in meeting a need. Would the City favour one kind o project (e.g. outdoor / indoor or sport / culture /cultural) above another? No. What would count would be the likely effect of the project. Might the City help pay for a build a small building for the community pre-school? Probably not at present but the province also has ECD programmes. Are there procedures to be followed in submitting proposals? And are there criteria used to assess proposals? 4. Youth Group Terry presented the planning done to date on the proposed Youth Group, whose vision was that of the South African Youth Charter. The Local Youth Forum would comprise Scarborough Youth working closely with Red Hill Youth. Scarborough would have its members and a Management Committee composed entirely of young people. There would be Sub-committees, of which one would be a Residents Steering Committee. A draft Constitution was distributed for comment. The Youth Group would be non-profit, would cooperate with all other bodies in Scarborough and all other users of the Centre, and would raise its own funds. The meeting expressed appreciation for these efforts, hoped the structure could be kept simple but asked that details like the need not to exclude anyone and the legal status of committee members under 21 years of age be looked into. Young people present looked forward to training workshops and having a safe place to meet. 5. Use of the Community Centre The District Manager: Sport & Recreation had indicated willingness to consider a proposal from Scarborough for free or reduced-cost use of the Centre for community activities, and for community involvement or even lease of the Centre. In the meantime, the City required all users to pay R45/hr. One possible approach would be for the Youth Group to book and pay for use of the Centre while waiting for the City to consider their application for free use. In the meantime, the Ratepayers Association should start negotiations with Sport & Recreation and try and apply for free use of the Centre for a youth evening on Friday 1 June. The Ratepayers Association would at the same time try and negotiate storage space for the Youth Group’s equipment. There already is a huge problem of users leaving the hall in a mess, and of leaving equipment in the hall. Cleaning up and storage will be a very important part of maintaining good relations between users of the Centre. 6.
